Do you mean they sued the counterparty directly ? In theory they shouldn't know who the counterparty was.
Big trades are broked OTC (even if they are crossed on the exchange later) in the inter dealer market and, depending on the market, the hedge (i.e. shares) is swapped back office to back office or in some other way directly between the counterparties (in which case you need to have some details which identify buyer and seller). It's also very common for brokers to exchange names and to know who the counterparty is (ideally Wink ) after you have done the trade.

Actually, it was $37 Million they lost in options In a German stock. Very speculative. I hate it when they win they were right when they lose they accuse of market manipulation.
